There is a bit of a loophole in a New York State law that it getting lots of attention this spring.

If the weather forecasts are accurate, we will be getting the warmer weather and sunshine we have been waiting for! There are still signs of the long winter around New York State as there are miles of ice on some portions of the Great Lakes.

But the boating season will be here soon and there is a law that you need to be aware of.

New York State Requirement

As for the start of this year (2025) there is a law that requires those who operate a boat to have a license and take a safety course.

According to the law, "Legislation passed in 2019 called Brianna’s Law, will require that all operators of motorized craft – regardless of age - complete an approved boating safety class by 2025".

This makes total sense considering the dangers that come with being on and operating a boat in open water and near other boats.

There is a lengthy course that is offered in New York State that you must take either in person or online in order to obtain the proper certificate to drive a boat.

The Exceptions To The Rule

There are many who are taking about the possible loophole in the law that may be a danger this boating season.

If you read the law fully, it indicates that those who RENT a boat are not required to have the certificate.

"complete an approved boating safety class by 2025 (Not required for those who are renting boats)".

Thousands of boats are rented each year and this does make you scratch your head when you look at the law.
